1. Acceptance of terms
By downloading, accessing or using the ThriftnDrift mobile application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you don't agree to these Terms, please don't use the App.
We may update these Terms from time to time. Continuing to use the App after a change means you accept the updated Terms.
2. Description of service
ThriftnDrift helps you discover thrift stores, vintage shops and secondhand retailers. The App provides:
- Store locations and information
- User reviews and ratings
- Community features for sharing finds
- Personalized recommendations
- Navigation and directions to stores
3. User accounts
3.1 Account creation
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Notify us immediately of any unauthorized use
- Take responsibility for all activity under your account
3.2 Account requirements
You must be at least 13 years old to create an account. Users under 18 need a parent or guardian's consent.
4. User conduct
When using ThriftnDrift, you agree not to:
- Post false, misleading or fraudulent content
- Harass, abuse or harm other users
- Violate any applicable law or regulation
- Infringe on intellectual property rights
- Attempt to gain unauthorized access to our systems
- Use the App for commercial purposes without permission
- Post spam or unsolicited advertisements
- Share content that is offensive, discriminatory or illegal
5. User content
5.1 Your content
You keep ownership of the content you post ("User Content"), including photos, reviews and comments. By posting, you grant ThriftnDrift a worldwide, non-exclusive, royalty-free license to use, display and distribute that content within the App.
5.2 Content moderation
We may remove content that violates these Terms or is otherwise inappropriate. We aren't obligated to monitor or moderate every piece of user content.
5.3 Content responsibility
You're solely responsible for your User Content. ThriftnDrift isn't liable for content posted by users.
6. Store information
Store information, including hours, locations and details, is provided for informational purposes only. While we aim for accuracy:
- Information may be outdated or incorrect
- We aren't responsible for inaccurate store information
- You should verify details directly with the store
- We don't endorse any particular store or business
7. Intellectual property
The ThriftnDrift App, including its design, features and content, is owned by ThriftnDrift and protected by intellectual property law. You may not:
- Copy, modify or create derivative works
- Reverse engineer or decompile the App
- Use our trademarks or branding without permission
- Extract data through automated means
8. Third party services
The App integrates with third party services, including Google Firebase for backend infrastructure, Google Maps for mapping, and Sign in with Apple and Sign in with Google for authentication. Your use of these services is subject to their own terms. We aren't responsible for third party services or their practices.
9. Privacy
Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use and protect your information.
10. Disclaimers
10.1 "As is" service
ThriftnDrift is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 No guarantees
We don't guarantee that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- Results from using the App will be accurate or reliable
11. Limitation of liability
To the fullest extent permitted by law, ThriftnDrift is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, use or goodwill, resulting from:
- Your use of, or inability to use, the App
- Any unauthorized access to or use of our servers
- Any interruption or cessation of the App
- Any bugs, viruses or harmful code transmitted through the App
- Any errors or omissions in content
- User content or the conduct of any third party
12. Indemnification
You agree to indemnify and hold harmless ThriftnDrift, its officers, directors, employees and agents from any claim, damage, loss, liability or expense, including legal fees, arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of another party's rights
- Your User Content
13. Termination
We may suspend or terminate your account and access to the App at any time, with or without notice, including for violating these Terms.
Once terminated, your right to use the App ends immediately. We may delete your account and content without liability.
14. Governing law
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
15. Dispute resolution
Disputes arising from these Terms or your use of the App will be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.
16. Changes to service
We may modify or discontinue the App, temporarily or permanently, with or without notice. We aren't liable to you or any third party for any modification, suspension or discontinuation of the App.
17. Severability
If any part of these Terms is found unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of the Terms will remain in effect.
18. Entire agreement
These Terms are the entire agreement between you and ThriftnDrift regarding use of the App, and supersede any prior agreements or understandings.
